Delhi court granted bail to an accused in a 2021 Mangolpuri murder case, noting he has been in custody for over four and a half years while only five of 34 witnesses have been examined, citing the right to speedy trial under Article 21.
The Supreme Court of India on Monday directed the release of Amit Mehra on bail, emphasising that an undertrial cannot be kept behind bars indefinitely.
Owaisi said, "The Supreme Court did not grant bail to two undertrial accused, and the Supreme Court explained why it did not grant bail. During the UPA government, the Unlawful Activities Prevention Act was amended, and included a definition of what constitutes terrorism."

The petition sought direction to issue guidelines to set polling stations in prisons for local prisoners and to make provision for postal ballots for prisoners lodged outside their home constituencies or states.
Tis Hazari court has recently acquitted an undertrial prisoner, Salman Tyagi, accused of assaulting the Deputy Jail Superintendent in Tihar Jail. The court acquitted the accused and said that the prosecution failed to prove the allegations beyond a reasonable doubt.
"An inmate, Aman, was killed by two other inmates, Jitender and Jaidev, inside the Saket Court lockup. Jitender and Aman had an old animosity due to an incident of assault that happened in 2024 when they both were outside the jail," Delhi police said.

Section 479 of the BNSS allows for the release of bail of those prisoners who have served significant periods of detention, particularly first-time offenders.
The Centre on Friday informed the Supreme Court that Section 479 of Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS), the replacement of the Code of Criminal Procedure, will apply to all undertrials in pending cases that were registered before July 1.
