Mumbai police arrested a 58-year-old man for allegedly raping his 19-year-old step-granddaughter for the past ten years. The accused threatened her with death if she ever shared the ordeal with anyone.
Additional Sessions Judge Babita Puniya convicted the man after analysing the evidence which established that accused raped his stepdaughter repeatedly.
The High Court had said that to make out an offence under POCSO Act, a child or children should have been used for pornography purposes. It added that to constitute an offence under IT Act the accused must have published, transmitted and created the material.
The Delhi High Court on Monday acquitted a man who was booked under the Protection of Children from Sexual Offences (POCSO) Act, 2012 and said that there are inadequacies and contradictions in the case of the prosecution.
