EBC quota: SC to hear Gujarat Govt.'s plea on Aug 22
New Delhi, Aug 12 (ANI): The Supreme Court will hear the Gujarat Government's plea on August 22 against the High Court order quashing the ordinance providing 10 per cent quota for the economically backward classes in government jobs and college seats. On August 4, the Gujarat High Court called the 10 per cent reservation for economically backward classes 'unconstitutional and illegal'. The court also observed that the ordinance promulgated by the State government is against the spirit of the Constitution and fundamental rights. In his petition, social worker Jayantbhai Manani stated that any special provision providing quotas based on economic criteria is not tenable under the law as the Constitution does not permit the same. The petitioner also stated that without the collection of the necessary data on economic backwardness among the upper castes, the government has issued the ordinance announcing reservation of 10 per cent seats to candidates belonging to the unreserved category with family income cap of Rs 6 lakh.
