Sweet justice for one, sour end for another: Delhi Court settles 33-year 'Chatmola' trademark dispute

Bringing an end to one of India's longest-running trademark battles, the Delhi District Court at Tis Hazari has ruled on the 33-year-old dispute surrounding the popular confectionery brand, Chatmola.

New Delhi [India], April 19 (ANI): Bringing an end to one of India's longest-running trademark battles, the Delhi District Court at Tis Hazari has ruled on the 33-year-old dispute surrounding the popular confectionery brand, Chatmola.

The legal feud, which began in 1992, was a deeply personal one--rooted in a family conflict between two brothers over rights to the Chatmola trademark.

The original litigant, Pritam Dass, passed away during the proceedings, leaving his son, Anil Kumar Gera, to carry the case forward. Opposing them was Ramesh Chander, who was just 37 years old when the case started and has continued to manufacture and sell his products under the trade mark Chatmola alongside his son, Rajat Gera.

Represented by advocates Shailen Bhatia and Amit Jain, Ramesh Chander relied on his trademark registration, arguing that his legal ownership granted him exclusive rights and protection under Indian law.

His counsel further pointed out that the opposing side failed to present crucial evidence, such as sales records or advertising expenditures, to establish independent goodwill associated with the mark.

Presiding over the case, ADJ Neha Paliwal Sharma examined all submitted documents before delivering the verdict. The Court ruled in favour of Ramesh Chander, issuing a permanent injunction against Anil Kumar Gera, barring him from using the Chatmola trademark for any confectionery products.

Furthermore, the lawsuit filed by Anil Kumar Gera, which sought sole ownership of the mark, was dismissed entirely.

The court has permanently barred the plaintiff and its associates from using the 'Chatmola' trademark or any deceptively similar mark for confectionery products, citing infringement of a registered trademark. Additionally, they are prohibited from using the baby elephant device and its distinctive features, as the defendant holds a valid trademark registration for both the label and the mark.

The verdict solidifies Ramesh Chander's claim as the rightful and registered proprietor of Chatmola, a product he has been manufacturing under the Rinka's brand since 1991--a legacy now carried forward by his son Rajat Gera along with his father. Chatmola is a well-loved Indian confectionery famous for its bold, tangy, and spicy taste. (ANI)
