MP High Court grants bail to man accused of raising anti-national slogan on condition to salute Indian flag saying 'Bharat Mata Ki Jai' 21 times

The court further directed that the accused, Faizal alias Faizan, a resident of Bhopal, will mark his presence before Misrod Police station between 10 am and 12 pm on every first and fourth Tuesday of month.

Bhopal (Madhya Pradesh) [India], October 17 (ANI): Madhya Pradesh High Court has granted bail to a man accused of chanting 'Pakistan Jindabad, Hindustan Murdabad' on the condition that he would have to visit a police station twice a month and salute the Indian national flag 21 times repeating 'Bharat Mata Ki Jai' each time till the conclusion of trial.
The court further directed that the accused, Faizal alias Faizan, a resident of Bhopal, will mark his presence before Misrod Police station between 10 am and 12 pm on every first and fourth Tuesday of month.
According to the order of the High Court, a case was registered against the accused Faizal alias Faizan at Misrod police station on May 17 this year under Indian Penal Code (IPC) section 153 B and he has been in detention since then.
Faizan's counsel has submitted that the applicant had been falsely implicated. Nonetheless, Faizan's counsel has fairly stated that in a video, the applicant is seen shouting the slogan. But he prayed before the court to grant him bail by imposing some stringent conditions.
The prosecution opposed the bail and submitted that the applicant is a habitual offender and 14 criminal cases are registered against him. He is openly shouting the slogans against the country in which he was born and brought up.
After hearing both the sides, Justice Dinesh Kumar Paliwal stated, "The applicant has a criminal background of 13 criminal cases and in the video he is seen shouting slogans aforementioned. However, taking into consideration all the facts and circumstances of the case, but without expressing anything on the merits of the case, I am of the view that the applicant may be released on bail by imposing some conditions."
"It is directed that applicant - Faizal alias Faizan be released on bail on his furnishing a personal bond of Rs 50,000 with one solvent surety in the like amount to the satisfaction of the trial court, for his regular appearance before the trial court during the trial", the order read, dated October 15.
"It is further directed that he shall continuously mark his presence before police station Misrod, Bhopal every 1st and 4th Tuesday of the month till the conclusion of the trial and shall salute the National Flag unfurled on the building of the police station 21 times raising slogan 'Bharat Mata ki Jai'," the order added.
"The aforesaid condition has to be necessarily incorporated in bail papers. The bail order shall be effective till the end of the trial. However, in case of bail jump and breach of any of the aforesaid conditions of bail, it shall become ineffective." it read further.
Along with this, the court also directed that the copy of the order be sent to the Commissioner of Police (CP) Bhopal to ensure compliance of the condition about the national flag and slogan "Bharat Mata Ki Jai". (ANI)
