Indore (Madhya Pradesh) [India], May 29 (ANI): The Indore bench of Madhya Pradesh High Court on Wednesday granted anticipatory bail to Akshay Kanti Bam, a Congress turncoat, and his father Kanti Bam in an alleged attempt to murder case.
Akshay Kanti Bam, who was the Congress nominee from the Indore parliamentary seat, pulled back his nomination paper and switched his sides to the Bharatiya Janata Party (BJP) on April 29.
Bam's lawyer Ajay Mishra told ANI, "Akshay Kanti Bam and his father had a dispute with Yunus Patel, a resident of the Khajrana area in the city, over a piece of land in 2007. After which, Bam and his father lodged an FIR against Yunus Patel in Khajrana police station under IPC sections 323, 324 and other sections of assault."
Later, Patel also lodged a cross FIR against Bam, his father Kanti Bam and three others in the matter under IPC sections 323, and 324 which are bailable sections. At that moment, section 307 (attempt to murder) was not mentioned in the FIR. After that when Yunus Patel's statement was recorded on the next day of the incident, then also there was no mention of a firing incident or section 307 offence, Mishra said.
"The police presented the chargesheet of the case in 2014, and since then Bam and his father have been on regular bail. Both Bam and his father Kanti Bam continuously appeared before the court during the hearing from 2014 to 2024. In April this year, Yunus Patel filed a petition in the court that section 307 should be added to the case. The court added section 307 and ordered Bam and his father to appear before the court by July 8," Bam's lawyer further said.
"After that, we applied for anticipatory bail in the Sessions Court and it was rejected. Thereafter we filed a petition for the same in the High Court and today the court has granted anticipatory bail to Bam and his father," he added.
It seems that the application for including section 307 in the case was filed in the court at the time of elections, which indicates a political conspiracy, the lawyer said.
"Agreeing with our arguments today, Justice P N Singh said that neither anyone was injured in the case nor were there any firing incidents reported in the statement given earlier. The next hearing on the matter will be held in the Sessions Court on July 8. We have also filed a petition for removal of section 307," lawyer Mishra concluded. (ANI)
