Kanjhawala hit-n-drag case: Delhi HC seeks response from police on bail plea of accused Krishan

The Delhi High Court on Friday sought a response from Delhi Police on a plea moved by Krishan, an accused in the Kanjhawla hit-and-run case of January 2023. Krishan has been charged with the offence of murder.

New Delhi [India], July 12 (ANI): The Delhi High Court on Friday sought a response from Delhi Police on a plea moved by Krishan, an accused in the Kanjhawla hit-and-run case of January 2023. Krishan has been charged with the offence of murder.
This case pertains to the dragging of a girl in the early hours of January 1, 2023.
Justice Amit Mahajan directed Delhi Police to file a status report and listed the matter for hearing on August 14.
His earlier bail plea was dismissed by the trial court on May 6, 2023.
Advocate JP Singh has moved a bail plea on behalf of accused, Krishan. The accused has been in custody since January 2023.
The Rohini District Court on July 27, 2023, directed to frame murder and conspiracy charges against four accused. Three other accused were charged with destruction of evidence, harbouring of the accused and other offences.
The court had directed to frame charges against Amit Khanna, Krishan, Manoj Mittal and Mithun under sections 302 (murder) 201( Destruction of evidence), 212 (harbouring), 120B ( Criminal Conspiracy) IPC.
The Court had directed to frame charges against Deepak Khanna, Ashutosh Bhardwaj and Ankush under sections 201, 212,182 (Giving false information to public servant),34 IPC by the court.
These three have been discharged from section 120B IPC. Additionally, Amit Khanna was also charged with the section of Negligence driving.
Delhi Police had filed a charge sheet under sections of murder etc. against seven accused persons on April 1, 2023. After framing of charges, the matter is at the stage of recording of Prosecution evidence.
In this case, a girl was allegedly hit by a car and dragged under it for 13 kilometres in the Sultanpuri area on the intervening night of 31 December 2022 and January 1, 2023.
Delhi police had submitted that there is sufficient evidence including CCTV footage, Statement of witness, and Mobile location of the accused to frame charges against them.
On April 13, 2023, the Magistrate court took cognizance of the charge sheet of Delhi police. Delhi Police had filed an 800-page charge sheet on April 1. Police invoked the murder section against the four accused. There total of seven accused in this case. Three accused are on bail in the matter.
Delhi Police had invoked sections of murder, destruction of evidence, conspiracy and other sections against four accused namely Manoj, Mithun, Krishan and Amit.
The charges sheet stated that on 01.01.2023, an FIR was registered at PS Sultan Puri, Delhi in which the victim Anjali was dragged for many kilometres after getting entangled under the vehicle.
During the investigation, seven accused persons Manoj Mittal, Amit Khanna, Krishan alias Kallu, Mithun alias Arjun alias KD, Deepak Khanna, Ankush Khanna, and Ashutosh Bhardwaj were arrested.
On completion of the investigation, a charge sheet of about 800 Pages has been prepared with around 120 witnesses cited in the present case, police said.
Based on the evidence collected during the investigation, to the best of our capabilities, sufficient material has come on record to prosecute accused person Amit Khanna for the commission of offence U/s 302/279/337/201/212/182/34/120B IPC & 3/181, 185 M.V. Act. Delhi police implicated accused Krishan for the commission of an offence under sections 302/201/212/34/120B/182 IPC.
Accused Mithun has been implicated for the commission of an offence under sections 302/201/212/34/120B/182 IPC. Another accused Manoj Mittal has also been implicated in the commission of offence u/s 302/201/212/34/120B/182 IPC. Apart from these three accused Deepak Khanna for the commission of offence U/s 201/212/182/34/120B IPC.
Delhi police have implicated Ankush for the commission of offence u/s 201/212/182/34/120B IPC. The accused Ashutosh has been implicated for commission of offence u/s 201/212 /182/34/120B IPC & 5/180 MV Act. (ANI)
