Delhi High Court rejects plea of alleged Sukesh Chandrashekhar for transfer from Mandoli jail

The court said we do not find any necessity for issuing directions for not transferring the petitioner to other jails if so necessitated for administrative reasons.

New Delhi [India], October 4 (ANI): Delhi High Court rejected alleged conman Sukesh Chandrashekhar's plea challenging his transfer from Mandoli Jail to any other prison.
The court said "We do not find any necessity for issuing directions for not transferring the petitioner to other jails if so necessitated for administrative reasons."
Sukesh had moved the court to seek directions to the jail officials not to transfer the petitioner from Jail No. 13, Mandoli, to any other jail given Rule 667(1) of the Delhi Prison Rules, 2018 and to direct the respondent to give him four days' advance notice in case of his transfer to any other court.
The plea stated that Sukesh be not transferred from Mandoli jail, as he has been suffering from various ailments, including gallbladder stones, since 2020 and had been taken to Safdarjung Hospital and RML Hospital.
The transfer would interfere with his medical treatment It is, therefore, submitted that he may not be transferred from this Court.
The bench of Justice Neena Bansal Krishna in an order passed recently, stated that the medical Status Report reflects that for his physical ailments, the petitioner has been taken to Safdarjung Hospital and RML Hospital and even to higher Centres as and when required.
Thus, for his physiological ailments, he is being treated at outside hospitals.
The court noted that it is claimed that he is suffering from anxiety and is being treated by a psychiatrist and his present condition is stable.
However, the Central Jail, Tihar, also has a similar facility for psychiatric treatment.
Therefore, such directions that interfere with the administration of the jail should not be made unless there are any compelling reasons or mala fides reflected on the part of the jail Administration.
No such grounds can be seen; rather, it is the petitioner who had filed an earlier Writ Petition, wherein he was seeking the transfer of one official from Jail No. 13, Mandoli. 9.
Therefore, considering that the treatment that the petitioner is undergoing can easily be made available to him at other jail complexes, this Court does not find any necessity for issuing directions for not transferring the petitioner to other jails, if so necessitated for the administrative reasons, said the court
However, a three-day notice be given to the petitioner in case he is being shifted from this jail to another jail, further added the court.
Recently, the Central Bureau of Investigation (CBI) has recorded the statement of alleged Conman Sukesh Chandrashekhar in connection with an alleged extortion racket operating from Delhi prisons.
Following the sanction from the Lieutenant Governor of Delhi, the CBI registered a preliminary enquiry and began investigating Sukesh's allegations regarding an extortion racket within the prison system.
In 2021, Sukesh Chandrashekhar was accused of extorting Rs200 crores from the wife of an industrialist through a series of extortion calls, further heightening the gravity of the case. (ANI)
