New Delhi [India], August 12 (ANI): The Delhi High Court on Monday disposed of a petition filed against advocate and AAP legal cell president Sanjeev Nasiar, noting that the verification report of the university concerned stated his law degree is genuine.
Naresh Chandra Gupta, former president of Delhi Bar Association, filed a petition claiming that law degrees of advocate Sanjiv Nasiar and Dilip Kumar Rana are fake.
Justice Sachin Datta disposed of the petition with a request to expedite the verification of Dilip Kumar Rana's degree.
"In view of the communications issued by the concerned university, there is no basis for the assertion/presumption in the writ petition that the LLB degree of respondent no 3 (Sanjiv Nasiar) is "forged and fabricated," Justice Datta said in the judgement passed on August 12.
"Thus, the concerned university has taken a clear stand that the degree (provisional and final) of respondent no 3 is "genuine and regular", the bench noted.
The bench also took note of communication of March 15, 2024, addressed by the concerned university, i.e., Devi Ahilya Vishwavidyalaya, Indore, to the Secretary, Bar Council of
Delhi.
The bench noted that in an order passed by the High Court on April 25, 2023, in a contempt case of 2016, it has already been directed that the complaint qua the respondent no. 4 (Dalip Kumar Rana) be placed before the aforesaid High-Powered Committee constituted by the Supreme Court.
The said order also specifically directs the Secretary of the Bar Council of India to place the entire paper book before the High-Powered Committee for the issuance of the appropriate directions to respondent no 1 (the Bar Council of Delhi) and the university for verifying the law degree of Rana.
The bench also noted that the affidavit of April 23, 2024, filed by the BCD discloses that the
requisite documents have already been forwarded to the Secretary of Bar Council of India, who is the Nodal Officer of the High-Powered Committee.
"In the circumstances, the High-Powered Committee is requested to expeditiously conclude the verification of the degree/certificate of enrolment of respondent no. 4," the judgement said.
The petition was premised on the allegation that respondent Sanjiv Nasiar holds the position of Vice-Chairman of the Bar Council of Delhi, although he is not qualified to remain in office since the documents upon which he has been enrolled as an advocate by BCD are not genuine and have been forged.
It was also alleged that the documents, based on which respondent Dalip Kumar Rana obtained enrolment with BCD are also not genuine and are forged and fabricated.
It is alleged that the BCD, with oblique motives, is not taking any action against Nasiar and Rana. (ANI)
