Court grants bail to jail staff accused caught taking drugs

Delhi's Karkardooma Court has recently granted bail to Mandoli Jail Staff (warder) who was caught taking drugs inside the jail premises.

New Delhi [India], August 30 (ANI): Delhi's Karkardooma Court has recently granted bail to Mandoli Jail Staff (warder) who was caught taking drugs inside the jail premises.
Additional Sessions Judge (ASJ) Sameer Bajpai granted bail to Nitin Rana who was in custody for last month.
The court said that the record shows that the accused has been in custody for about
one month and the investigation of him is complete.
Further, the applicant is a government servant and the court sees no chance that he will abscond or will not cooperate in the remaining investigation, the court said in the order passed on August 28.
"Considering the overall facts and circumstances, the application is allowed, the applicant/accused is admitted to bail on furnishing a personal bond of Rs 10,000 with one surety in the like amount," ASJ Bajpai ordered.
It is alleged that during checking the jail premises, the applicant/accused was found in possession of a substance like opium 100 gms.
It is further submitted that firstly, the applicant's bag and his body were fully checked by the ITBP and nothing was found in his possession.
Further, he was again checked at the CPRO gate and he was found in possession of 100 gms. Contraband opium at about 9.15 p.m.
It was submitted by the counsel for the accused that the allegations of the manner of recovery as mentioned in the FIR are concocted. Further, to prove his innocence, the applicant or accused preserved the CCTV footage of the security gate which will show that no recovery of the alleged substance was made in the manner in which it has been shown in the FIR.
It was further, argued that no complaint was given in the police station about the recovery of drugs on the same day of alleged recovery and the FIR was lodged on July 25, 2024, after six days of alleged recovery.
On getting a complaint from CRPF staff, the present case was registered and on July 27, 2024, the accused was arrested.
On the other hand, the Additional public prosecutor opposed the bail application and submitted that the offence committed by the accused was heinous.
Further, the recovered contraband is intermediate in quantity. The investigation is at the initial stage and the source of contraband is not traceable.
If the accused is on bail, he may affect the investigation, the public prosecutor submitted.
On July 20, 2024, a General Diary was received at Police station Harsh Vihar from the Mandoli Jail Complex that some suspicious substance was recovered from the possession of Jail Warder
Nitin Kumar Rana while searching by the CRPF officials at CPRO hall.
When the I.O. reached the spot the CRPF staff handed over one white envelope which was suspected to have 100 gms. Opium (2 bars). (ANI)
