In an official order, the Election Commission directed that neither of the two groups led by Roy and Banerjee shall be permitted to use the name of the party “All India Trinamool Congress” simpliciter.

Trinamool Congress (TMC) MP Kalyan Banerjee on Thursday questioned the rival faction's claims during the recognition hearing before the Election Commission, asking how they could claim that the party had ceased to exist in 2025 while being recognised as its legislative block in 2026.

West Bengal Leader of Opposition Ritabrata Banerjee on Thursday said the Election Commission of India must take the final decision on allotment of the Trinamool Congress' name and election symbol, as rival factions have submitted Forms A and B ahead of the Nandigram and Rejinagar Assembly by-elections.

The clarification came in response to a media report published on September 16 titled "In seat Kejriwal lost by thin margin, nearly 40% names added before 2025 polls now missing in SIR draft", which raised questions over names not appearing in the draft electoral roll of AC-40, including electors added before the 2025 Delhi Assembly elections.
