"Acted on CM Kejriwal's instructions": Virendra Sachdeva after Bibhav Kumar denied bail in Swati Maliwal's assault case

Welcoming Delhi's Tis Hazari Court's decision to reject the bail application of Bibhav Kumar in the Swati Maliwal assault case, Delhi BJP president Virendra Sachdeva alleged that Bibhav Kumar acted on Chief Minister Arvind Kejriwal's instructions.

New Delhi [India], May 27 (ANI): Welcoming Delhi's Tis Hazari Court's decision to reject the bail application of Bibhav Kumar in the Swati Maliwal assault case, Delhi BJP president Virendra Sachdeva alleged that Bibhav Kumar acted on Chief Minister Arvind Kejriwal's instructions.
Sachdeva said, "So far, from the police inquiry, it is clear Bibhav Kumar had no personal reason to beat and assault Swati Maliwal, hence he acted on CM Arvind Kejriwal's instructions."
Delhi BJP President further said, "Both Arvind Kejriwal and his family were present in the house when Bibhav Kumar assaulted Swati Maliwal but they did not react. It is clear that he pressurized Maliwal to resign from her Rajya Sabha seat."
"There may be two reasons behind this assault- either Bibhav on instructions of Kejriwal wanted Maliwal to resign or he wanted Swati to stay away from CM House on the instructions of Kejriwal's family. The police investigation will soon expose the truth," Sachdeva said.
Earlier, Tis Hazari court denied bail to Chief Minister Arvind Kejriwal's aide Bibhav Kumar after hearing arguments from both sides in the court.
Swati Maliwal, who was presented in the hearing, opposed the bail plea saying she was receiving threats. She broke down in tears during the hearing.
Senior advocate N Hariharan submitted that this bail application is maintainable. This is the right court that has jurisdiction to hear the bail application. In this FIR section 308 IPC has been invoked which is triable by the sessions court.
Advocate Hariharan argued that the complainant went to CM's residence and called PA Bibhav Kumar. PA Bibhav Kumar was not present at the CM's house, after which she headed towards the CM's residence without any permission or prior appointment.
"Can anyone enter in this manner, this is the official residence of CM," Senior Advocate Hariharan argued. There was a trespass and a report was also filed."
"She had no appointment for a meeting, and there was no message of her arrival," he argued.
At the outset, Delhi Police opposed the bail application by saying that it was not filed in an appropriate court. Bibhav Kumar is in judicial custody after a police investigation.
Kumar is accused of assaulting the AAP Rajya Sabha member at the chief minister's residence on May 13. He was sent to four days' judicial custody on May 24. (ANI)
