Aarushi murder case: Talwars' counsel points out lacunae in CBI probe

New Delhi [India], October 16 (ANI): The counsel for Nupur and Rajesh Talwar, Tanvir Mir Ahmed, on Monday pointed out major lacunae in the CBI probe over the Noida double murder case that shook the nation nine years back.

The dentist couple, who has been accused of the murder of their 14-year-old daughter Aarushi and domestic help Hemraj, had been lodged inside the jail since November 2013. They are expected to walk free today after the jail authorities receive the required court order.

Speaking to the media here, Tanveer said, "After facing so much humiliation, since November 25, 2013, when the CBI had put false charges and conviction on my client, the Talwars' prayers are heard. But today the agency is silent. I'm appalled to see that an agency so renowned made deliberate measures to put false allegations. Even today if you see, a report in a renowned newspaper on this matter said that Dr. Naresh Raj, a witness, had said that he was influenced to speak against the dentist couple. Even the High Court commented on the CBI's false charges, tampering of evidence, bringing false witnesses, and misplaced evidences."

He further said that they would be demanding security for the Talwars, citing a 2011 incident where the couple was attacked after the hearing.

"I'm also asking for a security cordon today as Rajesh Talwar had earlier been attacked," he said.

"We are expecting that anytime after 3:00 p.m. today the couple should be walking out of the jail. I had personally promised both of them; way back when they were unfortunately convicted that I would try my best in this case. It was kind of a solemn pledge. I'm glad I'm fulfilling my promise today," he added.

Further speaking on the release order and its progress, Tanveer explained, "People have already left for Ghaziabad; an application along with certified copy of the order will be placed on record before the court. Thereafter, we will present our sureties as well. Following that, a release order will be prepared. This release order is taken by the court staff to the Jail Superintendent. He then processes the release order and prepares the documentation with signatures and then releases them form the custody."

Meanwhile, earlier in the day, the jailor of the Dasna jail said that the dentist couple gave medical service for free to their prison inmates and refused remuneration amounting to Rs. 49,500.

The Jailor also informed that the couple would continue to visit the Dasna jail periodically so that the medical assistance could continue. He also said that there was a strong possibility of the couple to walk free from the jail by today noon.

Earlier in the week, the Allahabad High Court acquitted the Talwars of charges of their daughter's murder, setting aside the CBI court's earlier order, in connection with the double murder case that shook the nation in 2008.

According to reports, as per Section 437 (a) of the CrPC, the Talwars, even after their acquittal, will have to furnish a surety to ensure that they will be present in the court in case the state files an appeal in a higher court. (ANI)
