47-year-old tenancy dispute ends amicably during Supreme Court's Samadhan Samaroh

New Delhi [India], August 26 (ANI): A 47-year-old tenancy dispute involving a shop in Jaipur has finally reached an amicable settlement during the Supreme Court's Samadhan Samaroh, bringing an end to decades of litigation.
The dispute dates back to 1952, when the shop was let out on tenancy. The landlord initiated eviction proceedings in 1979, and the matter went through several rounds of litigation before eventually reaching the Supreme Court in 2017.
The case came up before a bench comprising Justice Pamidighantam Sri Narasimha and Justice Alok Aradhe on August 23.
During the pendency of the litigation, in 2003, the landlord had agreed to sell the disputed shop to the appellant, who also paid part of the sale consideration. However, despite the agreement, the dispute continued for more than two decades.
The matter was subsequently taken up under the Supreme Court's Samadhan Samaroh initiative, with the parties being facilitated by the District Legal Services Authority (DLSA), Jaipur, Rajasthan.
Following the mediation efforts, the parties reached an amicable settlement. Under the terms of the settlement, the respondent agreed to sell the disputed shop to the appellant for an agreed consideration.
Thus, a dispute that had remained locked in litigation for 47 years has finally come to an end--not through another round of adjudication, but through an amicable settlement facilitated under the Supreme Court's Samadhan Samaroh.
Samadhan Samaroh--short for Supreme Court Action for Mediated Adjudication and Disputes Harmonization Across Nation--is a Supreme Court initiative aimed at promoting "participative justice" and the "doorstep delivery of justice" by facilitating consent-based and amicable resolution of pending cases.
A three-day Special Lok Adalat was held at the Supreme Court from August 21 to 23.
The initiative covered several categories of disputes with potential for settlement, including civil and property matters, rent and eviction disputes, family and labour matters, banking cases, consumer and RERA disputes, taxation matters and service-related cases.
The Special Lok Adalat was designed to provide litigants an opportunity to resolve long-pending disputes through dialogue, mediation and other consent-based mechanisms, rather than continuing through prolonged adjudication.
The three-day Special Lok Adalat under Samadhan Samaroh saw 3,285 cases listed, with 1,664 cases settled or disposed of during the proceedings. Another 48 matters were resolved through mediation, bringing the total number of disposals to 1,712. (ANI)
